✅ All tents MUST be properly secured with weights to prevent movement, flying away, and any safety risks.
✅ Vendors are responsible for setting up and securing their own equipment.

Terms & Conditions

✔️ Vendors must arrive 1 hour before event start time for setup.
✔️ No refunds once registration is complete.
✔️ Vendors are responsible for bringing their own setup (tent, table, promotional materials).
✔️ Only family-friendly content & promotions are allowed.
✔️ No unauthorized fundraising or solicitation is allowed outside of registered vendors.
✔️ InCity HotSpots LLC reserves the right to approve or deny any vendor application.
✔️ Tents MUST be properly secured with weights for safety compliance.
✔️ Failure to comply with setup and safety requirements may result in removal from the event.

Waiver & Liability Release Agreement

1. Acknowledgment of Risk

I, the undersigned, understand and acknowledge that participation in the InCity HotSpots Family Night Event involves certain risks, including but not limited to:

• Potential injury or property damage due to weather conditions, public attendance, or other unforeseen circumstances.
• Possible loss, theft, or damage of equipment, inventory, or personal belongings.
• Risks associated with setting up, securing, and operating a vendor tent and booth in a public outdoor space.

I voluntarily assume full responsibility for any risks of loss, injury, or damages related to my participation in this event.

2. Release of Liability

I hereby release, waive, discharge, and hold harmless InCity HotSpots LLC, its directors, employees, volunteers, affiliates, event partners, the Brownsville Police Department, the City of Brownsville, and the hosting venue from any and all liability, claims, demands, or causes of action, including but not limited to injuries, property damage, financial loss, or other unforeseen incidents that may occur before, during, or after the event.

I understand that InCity HotSpots LLC and its affiliates are not responsible for lost, stolen, or damaged items and will not provide insurance coverage for vendors' personal or business property.

3. Vendor Responsibilities & Compliance

I agree to:

✅ Secure My Tent Properly – All tents must be standard 10x10 ft. and properly weighted down to prevent movement or safety risks.
✅ Set Up in My Assigned Space Only – I will not interfere with other vendors or event operations.
✅ Respect Event Policies – I will adhere to all event rules, including no unauthorized selling, solicitation, or fundraising outside of what is permitted.
✅ Be Responsible for My Equipment & Inventory – I acknowledge that I am fully responsible for my booth, displays, and any liabilities that may arise from my participation.
✅ Indemnify InCity HotSpots LLC – I agree to indemnify and hold harmless InCity HotSpots LLC from any claims, damages, or legal actions resulting from my participation.

4. Photo/Video Release

I grant InCity HotSpots LLC permission to photograph, film, and interview my business during the event. These materials may be used in future promotional efforts, social media, and marketing campaigns without compensation.

5. Event Cancellation & Refund Policy

I understand that vendor fees are non-refundable and that InCity HotSpots LLC reserves the right to cancel or modify the event due to unforeseen circumstances, including weather conditions.

6. Law Enforcement & Zero-Tolerance Policy

I acknowledge that law enforcement will be present at the event to ensure safety and compliance. I agree to follow all event policies and understand that violations may result in immediate removal from the event without refund.
